RIGHT OF WAY PERMIT AND EASEMENT Recording Fee$-AT-

THE UNDERSIGNED, its successors and assigns, in consideration of the sum
of One Dollar and other consideration, receipt of which is hereby acknowledged,
do grant to the City of Ames, Iowa, a municipal corporation, its successors and
assigns, the perpetual right to construct, reconstruct, maintain and use a
storm sewer, sanitary sewer, water and electric lines, consisting of poles,
wires, cables, conduits, fixtures, anchors and other similar equipment,
including the right to trim or remove trees within such area where necessary to
secure a clearance of 4 feet from the wires or poles, and a right of access for
equipment and vehicles g to ether with the right to extend to telephone,
telegraph, television, or gas companies, the right to use separately or jointly
with the City of Ames the areas included in this easement for the purposes
above enumerated, over, upon, across or under the following described real
estate, situated in the County of Story, State of Iowa, to-wit:
Commencing at the .northwest corner of Lot 5, Clear Creek Addition to
Ames, Iowa, thence north 49 feet along the west line of the Northwest
Quarter (NWJ) of the Southeast Quarter (SEJ) of Section 5, T83N, R24W
of the 5th P.M. Iowa, thence east 280.0 feet parallel to the north
line of said Lot 5 to a point on the southwesterly line of Lot 8 in
said Clear Creek Addition, thence southeasterly 26.0 feet to the
southwest corner of said Lot 8, thence southwesterly 24.3 feet along
the westerly right of way line of Westwood Drive to the point of
beginning; thence continuing southwesterly along said right of way
line 63.7 feet along a 109.9 foot radius curve to a point, thence
west 13.0 feet to the east line of said Lot 5, thence north 31 feet
to the northeast corner of said Lot 5, thence northeasterly 58.95
feet to the point of beginning. Containing 852 square feet.
It
is further promised by grantor that there shall be no construction or
erection of any building or structure on the described land or at any other
place where any part of such structure will be closer to the said wires
conduits, cables etc. than is allowed b the National Electric Safety Code

ANSIC-2 or over a gas, water or sewer main. Fences and materials storage is
permitted, but removal will be prompt on request of the grantee for exercise of
rights herein stated.
The foregoing rights are granted upon the express condition that the City
of Ames will assume responsibility for all damage to the above described
property caused by the City's failure to use due care in the exercise of its
granted right.
