SURFACE WATER DRAINAGE
RIGHT OF WAY PERMIT AND EASEMENT
THE UNDERSIGNED, in consideration of the sum of One
Dollar and other considerations, receipt of which is hereby
acknowledged, does grant to the City of Ames , Iowa, a municipal
corporation, its successors and assigns :
The perpetual right-of-way and easement
for drainage, management, and control of
surface water, including both normal and
extreme accumulations thereof, with the
right to install, repair, operate and
maintain such piping, conduits, intakes ,
drains, culverts and other devices as the
grantee shall deem useful to that purpose,
over, upon, across or under the following-described real estate,
situated in the County of Story, State of Iowa, to-wit:
Beginning at the Southeast Corner of Lot
C of Michael 's Subdivision of Lot 8, Curtis
Subdivision of Lot 3 in the NE4 of the
SE4 of Section 5, Township 83 North, Range
24 West of the 5th P.M. , thence north along
the east line of said Lot C to point of INST.NO. 070 ZI
intersection of said Lot C and the west STORY COUNTY, IOWA
line of Forest Glen Road, which point is PILED FOR RECORD
more or less 55 . 6 feet west of the west
line of Lot 6 of Caughey 's Subdivision of I APR 2 7 1984 PM
Lot 2 in the NEk of the SE4 of Section 5,
Township 83 North, Range 24 West of the SUSAN L.POTTER,Recorder
5th P.M. ; thence southeast along a line By Deputy
west of and 50. 0 feet parallel to the
westerly line of said Lot 6 of Caughey's
Subdivision to the north R.O.W. line of
Woodland Avenue; thence west along said
north line of Woodland Avenue to the point
of beginning.
Grantor shall retain the right to use and enjoy the
easement premises in any manner that does not prevent or impede
the exercise by the grantee of the rights granted hereunder;
but, it is expressly agreed and promised by the grantor that
there shall be no construction or installation of any building
on the described land which will interfere with grantee 's
rights hereunder. Fences , trees and shrubs are permitted but
removal will be prompt on request of the grantee, or the
grantee may remove the same, for exercise of rights herein
granted.

The foregoing rights are granted upon the express
condition that the City of Ames will assume responsibility for
all damage to the above-described property caused by the City's
failure to use due care in the exercise of its granted right.
All rights, title and privileges herein granted,
including all benefits and burdens, shall run with the land
and shall be binding on and inure to the benefit of the
parties hereto, their respective heirs, executors, admini-
strators, successors , assignees , and legal representatives .

SE 1/4 of Section 5, Township 83 North, Range 24 West of the 5th P.M. ,
thence north along the east line of said Lot C to point of intersection
of said Lot C and the west line of Forest Glen Road, which point is
more or less 55.6 feet west of the west line of Lot 6 of Caughey's
Subdivision of Lot 2 in the NE 1/4 of the SE 1/4 of Section 5, Township
83 North, Range 24 West of the 5th P.M. ; thence southeast along a line
west of and 50.0 feet parallel to the westerly line of said Lot 6 of
Caughey's Subdivsion of the north R.O.W. line of Woodland Avenue;
thence west along said north line of Woodland Avenue to the point of
beginning.
