HomeMy WebLinkAboutA003 - Council Action Form dated October 26, 1999 Item # Date: October 26, 1999 COUNCIL ACTION FORM SUBJECT: ABANDONING THE NORTH 64 FEET OF A UTILITY EASEMENT DESCRIBED AS THE SOUTH 180 FEET OF THE PREVIOUSLY VACATED ALLEYWAY ADJACENT TO THE EAST HALF OF LOTS 6, 7 AND 8 IN BLOCK 9 IN THE ORIGINAL TOWN OF AMES, STORY COUNTY, IOWA BACKGROUND: The Ames Daily Tribune Real Estate Corporation has requested that the City abandon a portion of the utility easement that exists over the vacated alleyway in Block 9, Original Town of Ames. The City of Ames sold the vacated alleyway to Ames Daily Tribune Real Estate Corporation in 1989 but retained a utility easement over the vacated alleyway. This easement was kept so the City and other utility companies could access electric lines, telephone lines, and storm sewer lines that are in the vacated alleyway. When the Ames Daily Tribune building was remodeled and expanded, the new building encroached into the north 64 feet of this easement. The owner has requested that the City abandon the north 64 feet of the utility easement to clear this issue from their title to this property prior to transferring the property to the new owners. Staff has determined that there are no utilities located in the north 64 feet of the utility easement and does not object to abandoning the north 64 feet of this utility easement. ALTERNATIVES: 1. Grant the request and abandon the north 64 feet of the utility easement. 2. Reject the request. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council abandon the north 64' of the utility easement described as the south 180 feet of the previously vacated alleyway adjacent to the east half of Lots 6, 7, and 8 in Block 9 in the Original Town of Ames, Story County, Iowa.
