BASEMENT
We, Martelle L. Cushman and Florence S. Cushman, husband
and wife,' in consideration of the sum of Dollar
( ) , receipt Whereof is hereby acknowledged, do hereby grant
to the City of Aces, a municipal corporation, its successors and
assigns, the perpetual right to construct, reconstruct, operate, and
maintain its electric lines consisting of poles, wires, cables, fix .:
tares, anchors, and other similar equipment, together with the
power to extend to any telephone,`a lectrie or power company the
right to use, jointly with the grantee, any ,pole placed pursuant
to the provisions hereof, upon, across.. over, or under the -follow-
ing described strips of land:
1. A strip of land 5 feet wide the East line of-which
is described as follows beginning at a point
located 560 Teat West of the Northeast corner of
Section 51 Township 83 North, Range 24 West of the

ng thence South 256.43 feet.
2. A strip of land 10 feet wide, the center line of
which is described as follows: beginning at a
point 528 feet East of the Northeast corner of
the West `43.68 acres of the Wi of the Northeast
fractional 1/4 of Section 5, Township 83 North,
Range 24 West of the 5th P. M. and running thence
South 25$.43 feet, and a strip of land 5 feet wide
the East line of which is a continuation of the
immediately above described line running South
123,07 feet further.
3. A strip of land 10 feet wide, the center line of
which is described as follows: beginning at a
point 103 feet South of a point 560 feet West of
the Northeast corner of Section 5, Township -83
North, Range 24 West of the 5th P. M. and running
thence West 596.45 feet to a point 103 feet South
of a point ,19.2 rods East of the Northeast corner ,
of the. test 43.68 acres of the Wj of the Northeast
fractional 1/4 of Section 5, Township 83 North,
Range 24 West of the 5th P. M. ,
together with the right to trim any trees along said lines where
necessary to secure a clearance of at least four feet for the mires.
The foregoing right is granted upon the express condition
that the City of Arises will assume liability for, all damage to the
ereinafter described property caused by said Cityts failure to use
due care in its exercise of °the granted right.
The real estate aboi a -referred to is specifically
described as follows:
Commencing 560 feet wist of the northeast corner of
Section ,5 Twp b 83' North, Range 24. West of the 5th -
P. M, of I wa; thence running west 384.9 feet; thence.
South 289A3 feet; thence east 385.45 feet; thence
north 289.43 feet to the place of beginning, contain
ing approximately 2,56 acres. Also, commencing on
the north line of Section 5, Township 83 North, Range
24 West of the 5th P. M. of Iowa at a point 19,2 rods <._r,4
east of the northeast corner of the West 43.68 acres
of the W2 NEI Pr. Sec. 5; thence south ,25 rods; thence
east 1.2.8 rods; thence north 25 rods to the north lino.
of said Section 5;' thence west along the north line of
said. Section 5 12.8 rods to the place of beginning.
Thirty feet reserved off the west side "of the premises
herein described for a public highway.
