The Mayor presided and the roll was called showing the following Council Members present and absent: Present: Campbell, Cross, Goodhue, Hoffman, Wirth Absent: Quirmbach Council Member Cross introduced the resolution hereinafter next set out and moved its adoption, seconded by Council Member Hoffman ; and after due consideration thereof by the Council,the Mayor put the question upon the adoption of said resolution, and the roll being called, the following named Council Members voted: Ayes: Campbell, Cross, Goodhue, Hoffman, Wirth Nays: None Whereupon,the Mayor declared the said resolution duly adopted, as hereinafter set out. At the conclusion of the meeting, and upon motion and vote, the ouncil adjourned. ayor Attest: City Clerk -1- DORSEY&WHITNEY LLP,ATTORNEYS AT LAW,DES MOMES,IOWA Ames/419370-24/1st''/z GBS RESOLUTION NO. 01-266 Fixing a date of meeting at which it is proposed to take action for the sale and issuance of not to exceed $10,100,000 General Obligation Corporate Purpose Bonds, Series 2001A, and providing for the advertisement of such sale WHEREAS,the City of Ames,Iowa(the"City"),proposes to issue not to exceed$10,100,000 General Obligation Corporate Purpose Bonds,Series 2001 A(the"Bonds"),pursuant to the provisions of Division III of Chapter 384 of the Code of Iowa for the purpose of the construction of certain street and storm sewer improvements,and it is necessary to fix a date of meeting of the Council at which it is proposed to take action for the issuance of the Bonds and to give notice thereof as required by such law; and WHEREAS, the City desires to offer the Bonds for public sale and to provide for the advertisement of such sale; NOW, THEREFORE, It Is Resolved by the Council of the City of Ames,Iowa, as follows: Section 1. This Council shall meet on the 10th day of July , 2001, at the o u it Chambers , in the City,at seven o'clock p m., at which time and place proceedings will be instituted and action taken for the sale and issuance of the Bonds. Section 2. The City Clerk is hereby directed to give notice of the proposed action for the issuance of the Bonds setting forth the amount and purpose thereof,the time when and place where the said meeting will be held, by publication at least once, and not less than 4 nor more than 20 days before the meeting,in a legal newspaper published at least once weekly,and of general circulation in the City. The Bonds,when issued,will constitute general obligations of the City,payable from taxes levied upon all taxable property in the City. At such time and place the Council shall receive oral or written objections from any resident or property owner of the City. After receiving objections,the City may determine to issue the Bonds, in which case,the decision will be final unless appealed to the District Court within fifteen(15)days thereafter. Sealed bids for the purchase of the Bonds shall be received and canvassed on behalf of the City at ten o'clock a.m.on the 1 Oth day of July,2001,at the Council Chambers, City Hall,in the City,and the City Council shall meet on the same date at seven o'clock-PL.m., at the Council Chambers,City Hall,in the City,for the purpose of considering such bids received and considering and passing a resolution providing for the sale and issuance of the Bonds. Section 4. The City Manager and Finance Director are hereby directed to proceed on behalf of the City,with the assistance of Dorsey&Whitney LLP,Attorneys,as Bond Counsel,and Evensen Dodge, Inc., the Financial Consultants,to advertise the Bonds for sale in an amount not to exceed $10,100,000;to participate in the preparation of a notice of sale of bonds to be prepared by the Bond Counsel for publication by the City Clerk in a legal newspaper located in Story County,Iowa,and in the preparation of a statement of information and solicitation of bids to be distributed on behalf of the City by the Financial Consultants,describing the Bonds and providing for the terms and conditions of their sale; to receive and canvass bids on behalf of the City Council and to take any and all other actions which may be necessary to provide for the sale of the Bonds on terms favorable to the City. Section 5. All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Passed and approved June 26, 2001.
